The AllMine.IO website (referred to as “Site”) is operated by DataKinex PTY. LTD. (referred to as “AllMine”, “AllMine.IO”, “we”, “us” or “our”). AllMine is registered in Australia under company number 640 514 932 with our registered office at 24/35 Merrigal Way, Port Macquarie, 2444.

What’s in these Terms of Use?

AllMine’s aim is to empower you to have more control over your Personal Information, Sensitive Information & Content and to monetise and profit from selling your data. These terms set out the conditions that apply to your use of our Platform and Services (“Terms of Use”).

Our Services

These terms of use set out the legally binding terms and conditions for your use of the AllMine platform and all related services, successor or replacement URLs (the “Website”) and any other websites, content, features or applications offered from time to time by AllMine in connection therewith (together, the “Services”).

We have developed the AllMine platform to allow you to capture Personal Information and Sensitive Information for monetisation and profit (through selling).

If you decide and choose to use the AllMine platform, you agree to us selling your data to selected Third Parties in order for them to sell or market their products and services to you. These products and services are not provided by us but are instead provided by the selected third parties over whom we do not have control. It is your responsibility to satisfy yourself that you wish to obtain any product before doing so. Before making a decision to purchase a product, you should consult the relevant product documents. The presence of a product on our platform does not constitute an endorsement by us of the provider, the product, the content of the provider’s website, or the activities of the provider.

Our Services are constantly evolving

AllMine is constantly learning (from our users and third parties) and evolving our platform based on these learnings. We reserve all rights to enhance and change our Services at any time. For example, this may include (but is not limited to):

• Changing which third parties we sell your Personal Information and Sensitive Information to whilst you are using the AllMine platform and have given consent to AllMine to do so;
• Changing the number of reward points that you can earn;
• Changing the AllMine revenue structure;
• Changing the products, vouchers/exclusive offers, gift cards, charity donations and/or any other items listed in the Marketplace and varying the terms applicable for access to the same; and
• Changing the Personal Information and Sensitive Information that we collect.

Things go wrong and we do not represent or warrant that access to the Service will be free of errors,  uninterrupted or without defect. We also do not guarantee that users will be able to access or use the Service, or its features, at all times.

We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service, or any part thereof, with or without notice.

The Service may contain formatting errors, classification errors, spelling errors, grammatical errors or inaccuracies and may not be complete or current. We reserve the right to correct any such errors, inaccuracies or omissions and to change or update information at any time without prior notice. We will however endeavour to at all times provide a change log for you so see what has changed when we do correct errors.

By using our Services you accept these Terms of Conditions and Use

By using our Services, you confirm that you accept these Terms of Conditions and Use and that you agree to comply with them. If you do not agree to these Terms of Use, you must not use our Services.

How we are paid

When we sell your data directly to our business partners they will pay for each block or category of information that you have made available for sale. For each transaction money from our business partner will be deposited into our bank account. We allocate the portion of the sale to your online profile, and set aside the money to honour your share of the sale in a provision account, so that your money is available for you to withdraw whenever you are ready to do so.

How you are paid

Once your data is sold you accumulate AllminePoints in your profile. Once you have enough points you can order your reward gift cards using the platform. You can order your cards as frequently as you prefer. This will be sent out using registered Australia post services.

Age requirements and eligibility

You must be at least eighteen (18) years old to use the Service. By using the Service, you represent that you meet this minimum age requirement.

If you’re under the age required to manage your own AllMine profile, you must have your parent or legal guardian’s permission to use the AllMine platform to manage your profile and details. Please have your parent or legal guardian read these terms with you.

If you’re a parent or legal guardian, and you allow your child to use the services, then these terms apply to you and you’re responsible for your child’s activity on the services.

Some parts or all of the Service may not be available to the general public, and we may impose eligibility rules from time to time. We reserve the right to amend or eliminate these eligibility requirements at any time.

By requesting to use, registering to use and/or using the Service, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and you commit to abide by all of the Terms and Conditions herein.

Licence and permission to use your information and Content

Some of our services are designed to let you upload, submit, store, send, receive, or share your Content, personal and sensitive information. You have no obligation to provide any Content or information to our services and you are free to choose the Content, personal and sensitive Information that you want to provide or share. You are also in full control of how that Content, personal and sensitive information will be used. If you choose to upload, share and sell your Content, personal and sensitive information, please make sure you have the necessary rights to do so and that the Content is lawful.

Subject to your compliance with this Agreement, we hereby grant you a worldwide, non-exclusive, non-transferable, non-sublicensable, and revocable licence to:

• access, stream, download, and use the content and the Service, including on your Mobile Device, made available in or otherwise accessible through the Service, strictly in accordance with this Agreement and solely for your personal, non-commercial purposes.
• We are not responsible to ensure, and disclaim any responsibility for, your ability to open, use or view the Service we provide. As between you and us, we retain all right, title and interest in and to the Service and all related intellectual property rights.

You acknowledge and agree that the Site, and the Service are provided under licence, and not sold, to you. You do not acquire any ownership interest in the Idea, the Site, or the Service under this Agreement, or any other rights thereto other than to use the App in accordance with the licence granted, and subject to all terms, conditions, and restrictions, under this Agreement. We and our licensors reserve and shall retain our entire right, title, and interest in and to the App, the Site, and the Service, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in this Agreement.

Content

Your content (referred to as “Content”) remains yours, which means that you retain any intellectual property rights that you have in your Content.

We need your permission if your intellectual property rights restrict our use of your Content. You provide AllMine with that permission through this agreement.

Personal and sensitive information

As an individual, you are unique and your information is extremely valuable. ALLMINE.IO believes you should share in the wealth that others gain when they use your information.

In order for us to collect, use and sell your personal and sensitive information that you provide to us, we need your explicit permission. Through this licence, you provide AllMone that permission and you can control how we are allowed to use your information on our platform.

Controlled by you

When it comes to privacy, we know that it is complex and that each individual has a different requirement as one size doesn’t fit all. In the AllMine platform, you will find that we have easy-to-use privacy controls for the data that you supply so that you can choose the privacy settings that are right for you.

When you provide your Personal Information and Sensitive Information, we give you full control over how that information will be used and you have the choice to change how your data is used at any time. When we sell your data, we will strictly adhere to the privacy settings that you specified.

You should be aware that as soon as you set your information preferences to make it private, we immediately stop sharing and selling it. It may however happen that your information was recently sold to customers that may still contact you with promotions, surveys etc. even after you make the change.

We sell your information, but not just to anyone

Our core service is to allow you to monetise and profit from your personal information. We sell your personal information to third parties that are interested in providing a product or service to you.  We take great care to ensure that the buyers of your personal information are legitimate businesses providing relevant services. At all times, you will be in full control of what data you make available to be sold.

Accuracy of information we sell

In order to sell your information so you may benefit from it we must be able to provide high quality data to our partner organisations who will pay you for it. Maintaining an impeccable reputation for the best quality data will ensure the best monetary reward for you. This means we need to make sure the data that you enter is accurate and  we need to ensure the data is of high quality. To that end we may:

• Validate/verify the identity of the account holder
• Validate certain elements of the data provided
• Deactivate accounts deemed to be duplicate
• Suspending accounts found to contain inaccurate information

Conduct

You can’t:

• Perform operations using the platform that is unlawful or encourages another to engage in anything unlawful;
• Upload and data that contains a virus or any other similar programs or software which may damage the operation of our or another’s computer;
• violates the rights of any party or infringes upon the patent, trademark, trade secret, copyright, right of privacy or publicity or other intellectual property right of any party
• Impersonate another person or legal entity
• breach, through the Service, any agreements that you enter into with any third parties;
• modify, adapt, translate, copy, reverse engineer, decompile or disassemble any portion of the Service;
• interfere with or disrupt the operation of the Service, including restricting or inhibiting any other person from using the Service by means of hacking or defacing;
• transmit to or make available in connection with the Service any denial of service attack, virus, worm, Trojan horse or other harmful code or activity;
• attempt to probe, scan or test the vulnerability of a system or network of the Service or to breach security or authentication measures without proper authorization;
• take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure;
• use any means to crawl, scrape or collect content from the Service via automated or large group means;
• make available false, incomplete or misleading information to the Service, or otherwise provide such information to us;
• attempt to access or access any portion of the Service that is not public; or
• attempt to override or override any security measures in place on the Service.
